Private and Consent

Under the relevant privacy laws, consent is required to collect, use and disclose any health information (with certain exceptions prescribed in the law such as when the collection, use or disclosure is necessary to lessen or prevent a serious threat to an individual’s life, health, safety or welfare).

Under the provisions of the Privacy Act of 1974, I need to have formal authorization from you before making an inquiry to a federal agency on your behalf. This law was enacted to protect individuals from unauthorised disclosure of personal information without their consent.

The legal definition of consent

POPI defines consent to be “any voluntary, specific and informed expression of will in terms of which permission is given for the processing of personal information“
